Thousands of people in the United States die each year as the result of medical error. According to a comprehensive and highly regarded hospital study by Harvard University, more than 1 million people suffer injuries each year as a result of mistakes caused by doctors, anesthesiologists, residents, nurses, technicians and malfunctioning medical devices. Medical malpractice also occurs in other settings, such as doctor’s offices or nursing homes. Most of the victims never know their injury was due to medical error. And most never sue. (Learn more.)

But investigations into such personal injury cases often reveal medical malpractice on the part of doctors, nurses and other health care professionals. And many lead to successful medical malpractice lawsuits. Whether failure to timely diagnose disease (see The Welteroth Case), inattention to patients (Caruso, Ebel, Gallagher) or birth injuries due to negligence (The $100 million Vlasny Case), the results are often catastrophic. Patients suffer injuries ranging from birth defects to brain damage to spinal cord injuries. In many cases, the patient dies. (See all news articles)

  • A jury has awarded a $3 million medical malpractice verdict to a widower after finding that a medical center and doctor were negligent in delivering care to his wife. The woman went to the emergency room complaining of stomach and lower back pain and was diagnosed with a kidney stone. She was sent home with a prescription for pain medication and a follow-up appointment two days later. About 48 hours after leaving the hospital but before her scheduled appointment, she suffered a seizure and went into septic shock. She died due to an infection from kidney stones. Hospital staff had failed to take her temperature before she left, and never told her to return to the hospital if she got a fever, an indication of a medical emergency in a patient with kidney stones. • A jury has awarded a $3 million medical malpractice verdict to a woman who suffered injuries during a hysterectomy. After removing her uterus, the doctor failed to identify certain anatomical parts in repairing the area. In addition, the surgical area was insufficiently sutured. The woman underwent emergency surgery three days later when her suture lines ruptured. Because there is a statuary cap on medical malpractice awards in this case, the judge urged both parties to use the jury’s verdict to negotiate a settlement. (Full story)
  • A jury awards a $4.25 million medical malpractice verdict to the family of a woman who died shortly after giving birth from a ruptured aneurism in a renal artery. Although an ultrasound showed blood near her kidney, physicians waited 16 hours before trying to stem the bleeding. (Full story)
