In a December 2011 case tried in a West Chester courtroom, the firm won an $805,000 verdict for the parents of a 35-year-old West Goshen man who died as a result of treatment at Chester County Hospital. John F. McGinley III was admitted for stomach pain and was given too much pain killer, exacerbating his sleep apnea and sending him into respiratory arrest. (Read news account)

In a county in which plaintiffs’ verdicts are difficult to attain, Kline & Specter also won a $1.2 million jury verdict in the case of Douglas Derr, who was standing at his driveway when a tractor-trailor struck a tree which then hit Derr, fracturing his skill and causing other injuries.

And in yet another Chester County civil suit that was seven days into a trial, Kline & Specter obtained a confidential settlement in 2010 in the medical malpractice case of Lathenia Petty, a mother of five who sued her primary care doctor, a radiologist and Pottstown Memorial Hospital after her ultrasound and radiologist report was sent to the wrong fax number. The error delayed her diagnosis of breast cancer for nearly a year and resulted in her death.

Other Chester County lawsuit victories included a $927,000 verdict for a woman who was admitted to Paoli Hospital for a recurrent kidney infection but started feeling pain and loss of feeling in her thumb after a PICC line was inserted in her upper arm. Later tests revealed nerve injury as a result of the insertion. The woman continued years later to suffer pain and loss of mobility of her right hand.

In a birth injury case, a settlement was obtained in a Chester County case involving brain damage suffered by an infant after a doctor botched the delivery. Terms of the agreement were confidential.
